Srinagar: The High Court of J&K and Ladakh on Thursday directed government authorities to release a detainee from jail to attend his son’s last rites.
The court of Justice Sanjay Dhar heard an application moved by petitioner, Ghulam Qadir Lone. He has been detained under provisions of Public Safety Act dated 30 March 2024 issued by District Magistrate, Ganderbal. The court was informed that his son Aqib Ahmad Lone has died as a result of drowning.
To support this assertion, the petitioner placed a copy of the death certificate of his son. He also included a copy of the entry made in the police record of Police Station, Kangan.
The government counsel also placed on record a copy. It confirms the fact that the petitioner’s son has lost his life due to drowning. The said occurrence has taken place on 5th August, 2024.
Justice Sanjay Dhar said that having regard to the aforesaid facts, “the petitioner deserves bail. This will allow him to attend the last rites of his deceased son. It will also enable him to be with his family in this period of grief.”
“So, court directed that the petitioner shall be enlarged on bail for fifteen days from the date of his release from the custody subject to the following conditions:
(I) That he shall give bail bond with one surety for Rs.50000 (rupees fifty thousand) each to the satisfaction of Superintendent, Central Jail, Kathua, Jammu.
(II) The concession of bail extended to the petitioner shall be used by him only for attending the last rites of his deceased son. He shall not use it for any other purpose.
(III) That the petitioner shall report to SHO, P/S Kangan, on every alternate day.
(IV) The petitioner shall not leave the limits of Police Station, Kangan. They need the prior permission of the concerned SHO.
(V) The petitioner shall surrender before the Superintendent, Central Jail, Kathua, Jammu. This must be done at once upon expiry of the period of bail.
