The High Court of Jammu & Kashmir and Ladakh has directed the SSP Handwara to ensure protection of a couple who approached the Court alleging threats and interference from family members over their marriage.
The petitioners invoked Article 226 of the Constitution, stating that they are major adults who solemnised their marriage out of their own free will and consent, but were facing threats to their life and personal liberty. They placed on record their Nikah Nama dated 14.07.2026 and documents establishing their age.
Relying upon the Supreme Court judgment in Lata Singh v. State of U.P., the Court observed that two consenting adults have the right to marry a person of their choice and no individual or authority can interfere with such a decision.
The Court noted, “Two consenting adults are entitled to marry of their choice and no individual or authority can interfere with such a decision.”
Directing police authorities to safeguard the couple, the Court ordered the SSP Handwara to issue necessary directions to the SHO concerned to ensure that the petitioners are not subjected to “any harassment, intimidation, threats, or physical harm” by any person.
