‘Explain why court orders are violated,’ HC calls Comm/Sec to govt

Srinagar: The High Court of J&K and Ladakh on Friday sought personal appearance of Commissioner/Secretary to the government, Housing and Urban Development Department to explain why Court orders are being violated.

The petitioner, Mudasir Ahmad Banday sought implementation of order dated 11 March, 2016  whereby the authorities were directed to fill up the posts of Chief Enforcement Officer and Chief Sanitation Officer in accordance with the criteria in vogue with reference to the applicable norms and rules. 

It was directed by court that while filling up the posts of Chief Enforcement Officer and Chief Sanitation Officer, the petitioner shall also be considered for such promotion.

The authorities filed the statement before court submitting that in terms of government order in 2017, sanction was accorded to the grant of charge allowance in favour of the petitioner against the post of Chief Sanitation Officer till the State Level Departmental Promotional Committee(DPC)is conducted. 

It was submitted that DPC is to be conducted by the Administrative Department. However, the Administrative Department has not filed any statement of facts or compliance report before court.

Justice Sanjay Dhar while hearing the arguments directed that Commissioner/Secretary to the Government Housing and Urban Development Department, Civil Secretariat Srinagar/Jammu shall appear in person on next date of hearing and explain as to why the order of the writ Court is not being implemented.

The  court will again hear the matter on 4 November, 2024.
