Court sought details about one person namely Imran Ahmad Mir who was picked up by Police station Khanyar on August 1 as per his family but police is denying his arrest
Srinagar: The High of J&K and Ladakh has called for personal appearance of Senior Superintendent of police, Srinagar, Station House officers of Nowhatta and Khanyar police stations to detail out the whereabouts of one Imran Ahmad Mir who was picked by police on August 1 according to his family.
Justice Sanjeev Kumar while hearing the plea of brother of the Imran Ahmad Mir stating that Mir is a student of B.A. Final year and is presently studying in Government Degree College Bemina, Srinagar.
“He was picked up by the Police Station Khanyar, Srinagar on 1st August, at 3 pm from his residence in presence of family members. On account of this, an application was moved before the Chief Judicial Magistrate, Srinagar for release of the petitioner.
However, the report called by the Chief Judicial Magistrate, Srinagar from the Police Station, Khanyar and in response thereto, SHO Police Station, Khanyar, Srinagar, submitted that “he has not arrested any person by the name of Imran Ahmad Mir.”
Another application was moved for seeking report from SHO Police Station, Nowhatta, from where also, a response came that the said individual has not been arrested.
The brother of the petitioner submitted before court that the petitioner is in wrongful confinement and has not been produced before the competent Magistrate for remand.
Court noted the concern of the family of the petitioner that the Police Station Nowhatta, Srinagar, as also Police Station Khanyar, Srinagar, have refused that they have arrested the petitioner and, therefore, “it is apprehended that two police stations may cause harm to the life and liberty of Petitioner-Imran Ahmad Mir.”
