J&K High Court seeks report on trial cases of former and sitting lawmakers

Srinagar: “Last opportunity is granted”, High Court of J&K and Ladakh directed Central and J&K government to apprise court of the current status of trial of former members of the legislative assembly and sitting or ex-parliamentarians in Jammu and Kashmir.

Chief Justice Arun Palli and Justice Rajnesh Oswal while hearing  a Suo Moto Public Interest Litigation passed the order after counsel for the both centre and J&K government prayed to comply with the order dated April 21 wherein the court had directed to submit the status report regarding the trial of former or current lawmakers.

Court while listing the matter on August 11 said that if the status report was not filed “appropriate order shall follow”.

Earlier in September, 2022 the court said that 13 former members or current members of the legislative assembly are facing trial in Jammu and Kashmir.

The plea was registered as Suo Moto in 2021 by the court in compliance to the directions of the Supreme Court, directing for monitoring the progress of the trial of cases pending against the sitting and former lawmakers.

On 20 September 2021, the court arrayed concerned officials from Jammu & Kashmir and Ladakh as respondents. Subsequently it directed them to submit information regarding the number of cases pending in different subordinate courts as well as the matters pending in the High Court against these lawmakers.
