HC issues warrant against a person making remarks on ‘sitting and retired Judges’

Srinagar:The High Court of J&K and Ladakh on Tuesday issued  a bailable warrant against one Mohammad Himayun Gani ‘for making scurrilous allegations against the sitting and retired judges of the court.’

The Bench of Justice Rajesh Sekhri and Justice Atul Sreedharan recorded that in terms of order dated 4 September,2023- the appellant, Gani has made scurrilous allegations against the sitting and retired Judges of this Court which ex-facie constitutes criminal contempt.

The Bench said that the Court has already issued notice to the appellant under section 12 of Contempt of Courts Act, 1971 to show cause why he should not be tried and held guilty for an act of criminal contempt against this Court.

“However, he has remained absent on two consecutive hearings including today,” Bench recorded.

As of such, Court directed that under circumstances, we issue bailable warrant in the amount of Rs. 50,000/- to be executed by the concerned SHO to secure the presence of the appellant before this Court on next date of hearing.

The court will again hear the matter on 2 December,2024.
