The girl was kidnapped, according to her father
Srinagar:The High Court of J&K and Ladakh on Wednesday directed Director of Social Welfare Department to hand over the custody of a minor girl to her maternal aunt as she needs care and affection in view of her health and pregnancy.
Justice Wasim Sadiq Nargal passed the direction after seeking consent of the father of the girl.
“Keeping in view the peculiarity of the health of the girl and also in the light of the fact that she is five months pregnant and requires immediate medical care, this Court deems it proper to hand over the custody of the girl for the time being to her maternal aunt, namely, Kounsar Begum of Anantnag,” court said.
Court recorded that in the light of the fact that the girl has also shown her willingness to remain with her maternal aunt, as she is in dire need of love and care at this crucial stage.
Justice Nargal directed the Director Social Welfare to hand over the custody of the girl to her maternal aunt and “ keep the girl under his continuous supervision and monitor the health condition of the girl and provide her regular medical care and check up by a specialized lady gynecologist, as already ordered by the Court in terms of previous orders.”
“This order has been passed in presence of the father of the girl and with his consent.
List this case on 12 December,2024,” court ordered.
Earlier, the father of the girl had alleged that her daughter was kidnapped.He had filed a plea before court seeking her daughter’s whereabouts after police failed to recover the girl according to the father.
It was only after the court had directed concerned authorities to nab the girl and produce her before court.The investigation in the matter is still ongoing.
The court also reviewed the dispute regarding the age of the girl whether she is a minor or major had called Secretary, School Board of Education which had authenticated that the girl’s age is 15 November,2006.
