HC of J&K issues warrant against govt officials for their ‘wilful disobedience of Court orders’

Srinagar: The High Court of J&K and Ladakh has issued bailable warrants against Commissioner/Secretary to govt, Social Welfare Department and Commissioner/Secretary to govt,Finance Department “ for their wilful disobedience of Court orders” in a contempt plea.

The Court of Justice Rahul Bharti sought personal appearance of the two officials namely Sheetal Nanda and Santosh Vaidya by 11 October for their ‘negligent behaviour towards court directions and failure of implementation.’

The Court directed the Registrar Judicial to issue bailable warrants for an amount of Rs.50,000/- each against the said two officers for their personal appearance before the Court on 11 October.

The Court also directed the Director General of Police of J&K to execute the warrants on the said officers with the return of process by next date of hearing failing which the “Court will be constrained to even direct the Director General of Police to appear before this Court on the next date to explain his default in serving the bailable warrants along-with both said officers,” Justice Bharti directed.

The Court passed the strict directions in a contempt plea by 18 petitioners complaining about the willful non-compliance of direction given by the court in a service writ petition no. 1435/2017 in terms of an order dated 01 August,2018.
