Court directs JKSSB to allow candidates of overage in the recruitment
Srinagar:The High Court of J&K and Ladakh on Friday granted relief to the aspirants who exceeded age limit to appear for JK police Constable recruitment through Jammu and Kashmir Service Selection Board(JKSSB).
The Jammu Bench of the court led by Justice M A Chowdhary while considering the matter and hearing the counsels at length directed respondents to consider the candidature of the aspirants irrespective of their maximum age.
Justice Chowdhary recorded that after a gap of eight years and against government instructions without giving any relaxation to the candidates who became overage in the intervening period due to the deliberate inaction of respondents against the policy adopted by various departments including the present indenting department alleging the same to be highly discriminatory and against the fundamental rights of the petitioners.
The court as interim order said,”for undergoing the test for the post of Constables let respondents entertain the applications of the petitioners provisionally and conduct their tests alongwith other candidates, who have applied for the vacancies.”
However, Court made it clear that their appearance in the test shall not give them any additional incentive for the consideration of appointment, which shall be subject to the outcome of the petition.
Earlier, a number of petitioners had filed a plea under Article 226 of the Constitution of India for being aggrieved of the advertisement notification of 2024 dated 16 July 2024 issued by the Jammu & Kashmir Service Selection Board, whereby it invited applications for 4002 posts of constables in J&K Police but didn’t consider the candidates who had exceeded age limit.
The court will again hear the matter on 21 February, next year.
